1.Applicability of the General Conditions of Sale
ARIES Cyclingwear can change the terms and conditions at anytime. Each order placed after a change means you accepted the new terms and conditions.
1.2. We sell our products exclusively to consumers of minimum 18 years and we only sell quantities that are customary for consumers.
2.Concluding an agreement
2.1.The presentation of our products on the Andrea Tafi web shop is a noncommittal invitation to order your products here. By sending your order you make a binding offer to conclude a purchase agreement. This offer will be accepted by us by delivering the goods. We are free to decide whether we accept or reject an order. If we do not carry out an order, we will inform you immediately (see point 3).
2.2.The ordering procedure on the Andrea Tafi web shop includes the following steps:
You can select individual products by clicking on the button “add to shopping cart”. The electronic shopping cart will automatically collect all your selected items. From the shopping cart you go to checkout process by clicking on the button “proceed to checkout”.
If you order from Belgium or the Netherlands, you thereafter have to chose a service point if available: your preferred Tafi dealer. He is happy to offer the necessary support for all your questions about our products. If you order outside Belgium or the Netherlands, skip this step.
Fill in your personal details. Make sure that you fill in your personal details correctly, which allows us to deliver the package perfectly or to contact you easily.
Select the method of delivery you prefer: depending from which country you’re ordering
->in a Tafi Service point (Tafi dealer of your choice): only in Belgium and the Netherlands
-> at an address of choice via DPD
-> in a DPD Parcel Shop(if available in your country)
Finally you will have to select the method of payment you prefer. By clicking on the button "Place Order" you will then be connected to the module of our payment provider (see point 5). Until you have click on this button, you can change the order and the details of your order.
A binding order will be only established when you have given all the required data agreed in the terms and conditions, when you clicked on the button "Place Order" and when the payment was completed successfully by the module of our payment provider.
After you have placed your order, you will receive an automatically generated confirmation of your order by email. This acknowledgment of receipt indicates only that your order has been received by us; it is not an acceptance of the order which means that it does not establish any purchase agreement yet. The order will be accepted by delivering the product. The order will be delivered after receiving the payment.
2.3.Aries Cyclingwear srls has the right to refuse orders because:
Of stock-out or when the product is no longer available (see point 3);
When discovered that there was an invalid presentation of products in the Andrea Tafi web shop;
With serious suspicions of abuse of rights or because of bad faith of the customer;
In case of force majeure, where it can be assumed that the Customer has the intention to resell the articles.
If we discover during the process of your order that one or more of the ordered products is unavailable, we can unfortunately not complete your complete order. In this case we reserve the right to choose whether the order will be carried out partly or refused completely. In this regard, you will be immediately notified with an e-mail. An agreement on the non-available products will not be established, repayment is guaranteed (see point 6).
4.1.Our products will only be delivered in the countries in which the Andrea Tafi web shop permits the delivery.
4.2. You chose the method of delivery you prefer and which is available in your country:
->Belgium/Netherlands: you can have your order delivered to your selected Service point (Tafi dealer of your choice)
-> at an address of choice via DPD
-> in a DPD Parcel Shop if available in your country
Erroneously communicated addresses are the responsibility of the customer and may result in additional costs. PO Box addresses and military APO addresses are not accepted.
4.3.Depending on the method of delivery you have chosen, the order will be delivered, as far as possible and in the normal course of business, within three to five business days after the date of order, provided that your information is accurate. Any delay will in no case result in damage indemnity.
4.4.Until we have started processing your order, we can cancel your order, free of charge, if you contact our Customer Service. We will pay you back the price of the ordered goods within 30 days. Has your order already been shipped ? In this case you can return it using the return form. Transport costs are then obviously for your charge. (see point 6 relating to return policy).
4.5.If, due to exceptional circumstances, we can not succeed to deliver your order within 30 days after the automatically generated confirmation mail, you can cancel your order free of charge by contacting our Customer Service. We will refund the full price of the ordered products (including the shipping cost you paid) within 30 days.
5.Price and Payment
5.1.ARIES Cyclingwear srls reserves the right to correct any errors (eg. Due to technical defects). The prices of the Andrea Tafi web shop are being valid as long as this prices are online and as long as the stock lasts. Within all prices, the VAT is included.
5.2.We charge postage for each order <100 euros including VAT.
6.1.Regardless of your right of revocation (see point 11), we offer the opportunity to return the products ordered from us. Provided that the original tags are still attached to the products and that the products are folded in their original packaging, you can return all products which are in complete, in unused and in undamaged condition, within 14 days after receiving the product without stating the reason. It is only allowed to fit the products as it is common to fit clothes or accessories in a normal retail shop. For products with a special hygienic sticker or hygienic closure applies the foregoing, insofar as this sticker or closure was not removed or opened. Products that do not comply with the foregoing remain property of the customer. We will send the products back to the customer and we will charge them for the extra costs made. You can send back the products by means of the enclosed return document via DPD or your own transport company/post to the following address: Tafi Sports BVBA, Haverheidelaan 13A, 9140 Temse, Belgium. The return has to be paid by the customer.
The return via DPD will be paid by you. We will refund the price of the returned products within 30 days of receipt, with exception of the by you paid shipping costs.
6.2.Article 6.1 does not apply to products which are individualized according to customer specifications.
7.1.Unless explicitly agreed otherwise, the statutory warranty applies (Art. 1649bis and following of the Civil Code). Any default in a product must be reported within 2 months of its noticing. Afterwards, all rights for a reparation or a replacement will expire.
7.2.In any of this cases, you will not be able to claim any warranty:
Normal wear and tear of the product
If by improper or abnormal use of the product or by using the product contrary to the purpose for which it was designed.
if use and maintenance instructions haven’t be followed correctly
if product has been damaged on purpose
if product has been changed/repaired by yourself or third person
in case of commercial use
if original order or return document is not attached
8.1.Use of the Andrea TAFI webshop:
Information on the Andrea Tafi webshop is general information. The information isn’t adapted to personal or specific circumstances, and can’t as a result be considered as personal or professional advice. AT Sports is working hard to deliver you correct information. Despite these efforts, it can happen that errors or misinformation occur. If this is the case, AT Sports will everything what possible to implement the changes as soon as possible. AT Sports can’t be hold responsible for direct or indirect damage who could arise by the use of this information. If you remark errors in our website, please contact the administrator of the site (contact details below).
Size information given on this website remains an estimate. We can’t even guarantee that colors on the website are 100% reproduced or that the delivered goods slightly differ from the website. AT Sports is not responsible for the loss or damage a customer or third person could occur by use of our products.
De content of the site (links included) can be reviewed at any time without announcement or information. AT Sports can’t be responsible for the bad operation of the website of temporary unavailability. AT sports can’t in any case be responsible for the damage who could occur by use of this website, included by the result of the use of links and hyperlinks resulting in damaged software, work interruptions, damaged data of the computer system/hardware.
The website can contain hyperlinks to other websites or pages of third parties. This may not mean that we approve the content of these websites. AT Sports is not responsible for the content of these website and is in not responsible for the damage who could occur from these websites.
8.2.In general about the liability of AT Sports:
AT Sports is not responsible for any damage caused by her fault or neglect except if it has been done on purpose, also by one of her employees. Each damage which can’t be foreseen by closure of the agreement, is excluded from reimbursement. The liability of AT Sports is always limited to direct, personal damage and will never exceed the purchase price of the product in question.
8.3.Use of material from the Andrea Tafi website:
Information of the Andrea Tafi website can only be used/reproduced if At Sports gives it’s written approval. It’s forbidden to copy, reproduce, download, distribute, commercialize services, pictures, pages of the webshop or information codes.
9.Copyright and Intellectual Property
9.1.We developed the Andrea Tafi webshop for personal and non commercial practical purposes of the customer. The lay-out and structure of this website, texts, graphics, pictures, illustrations, noises, software are property of AT Sports. All rights linked to this, and especially all intellectual property rights are managed by AT Sports, except all intellectual property rights on name of “Andrea Tafi” and the common brand “AT Andrea Tafi” n°009615998, which are exclusive property of Mr. Andrea Tafi and where AT Sports is the exclusive license holder.
The customer may only download the content and make one copy for personal use (no commercial use) only if the content of this material remains in original condition. Copy or save any content for commercial use is not allowed.
9.2.All brands, trade names, logos and products used in the webshop are protected and can’t be used without written approval of AT Sports. For what concerns the name “Andrea Tafi” and the brand “AT Andrea Tafi” approval needs to be asked to Mr. Andrea Tafi.
Even if the brands “AT Andrea Tafi” are property of Mr. Andrea Tafi, the products are made by (or for) AT Sports which is (contrary to Mr. Tafi) the producer conform Article 3 of the Law of 25 February 1991. All signs, illustrations, images, logos who are present on our products, packaging, accessories are and remain the exclusive property of one hand, AT Sports and on the other hand, Mr. Andrea Tafi. The reproduction, totally or partially, for which reason it could be, is strictly prohibited. Also the use in each combination with another sign, symbol; logo or other distinctive sign is prohibited.
10.Applicable law and disputes
Only Italian law is applicable. All disputes related to closure, validity, interpretation or execution of the agreement or of the actual General Conditions are competence of the Belgian Court.
11.Right of withdrawal
Recall of the agreement without any reason is allowed within the 14 days. To practice this right, you need to fill in the return document attached to the document and send it back to us by post, fax or mail.
The recall period of 14 days starts the day after delivery date.
